Service Terms and Cancellation Policy

Effective date: July 21, 2026

These Service Terms and Cancellation Policy govern paid services provided by Auto Lien Service. By authorizing work, submitting a file, or paying an invoice, the client agrees to these terms.

Scope of Services

Auto Lien Service provides administrative vehicle lien-processing services that may include:

  • File and document review

  • Oregon DMV vehicle record requests

  • Identification of registered owners, legal owners, and security interest holders

  • Preparation and mailing of notices

  • Certified-mail coordination

  • Publication coordination

  • Auction scheduling and documentation

  • Preparation of applicable Oregon DMV possessory lien foreclosure certificates

  • Title-application support

  • File organization and record retention

The accepted invoice, proposal, intake confirmation, or written communication identifies the services included for a particular file.

Auto Lien Service does not provide legal representation, court filings, litigation services, repossession services, physical towing, vehicle custody, appraisal services, auctioneering, or title guarantees unless expressly stated in writing.

Client Responsibilities

The client must provide complete, accurate, and timely information, including:

  • The correct VIN, plate number, vehicle description, and location

  • The date and legal basis for possession

  • Repair orders, estimates, invoices, storage records, tow authorizations, impound forms, leases, rental records, or other supporting documents

  • The identity of the party who authorized work, storage, towing, or possession

  • Accurate charges and payment records

  • Prior notices, owner communications, title documents, and known disputes

  • Any known lender, security interest, bankruptcy, probate, law-enforcement, court, or out-of-state issue

The client must promptly review prepared documents and answer requests for information. The client is responsible for the underlying claim, possession, charges, authorizations, and factual statements.

Authorization for Record and Processing Work

The client authorizes Auto Lien Service to use submitted vehicle and claim information to perform the accepted services.

When a DMV record request is part of the service, the client represents that the request has a lawful lien-foreclosure, notice, title, or other permitted purpose. The client must not request vehicle information for personal curiosity, harassment, marketing, surveillance, or another unauthorized purpose.

Auto Lien Service may reject or stop a record request that appears unsupported or unlawful.

Fees and Third-Party Costs

Service fees are stated in the applicable quote, invoice, pricing page, or written acceptance.

Additional costs may include:

  • Oregon DMV record fees

  • Certified-mail and postage charges

  • Newspaper publication charges

  • Auction provider charges

  • Appraisal or valuation charges

  • Title, inspection, registration, or Oregon DMV fees

  • Returned-payment or payment-processing charges

  • Other third-party costs required by the file

Third-party fees may change without notice and remain the client's responsibility unless Auto Lien Service expressly agrees otherwise in writing.

Payment

Payment is due according to the applicable invoice or written service arrangement. Auto Lien Service may require advance payment before ordering records, mailing notices, publishing advertisements, scheduling an auction, or preparing final documents.

Auto Lien Service may pause work when an invoice, deposit, postage amount, publication cost, or other required payment remains unpaid.

Cancellations

The client may request cancellation by contacting Auto Lien Service.

Cancellation does not reverse work already completed, records already ordered, notices already mailed, advertisements already placed, auctions already scheduled, or third-party costs already incurred.

Auto Lien Service may cancel or suspend a file when:

  • Required information is missing or inconsistent

  • The client does not respond

  • Required fees are unpaid

  • The requested action appears unlawful or misleading

  • The client lacks authority to request the service

  • The matter requires legal advice or litigation

  • A dispute, court order, law-enforcement issue, bankruptcy, or other complication prevents administrative processing

  • Continued work would expose Auto Lien Service or another party to unreasonable legal or operational risk

Refund Policy

Fees earned for completed work are nonrefundable.

Government charges, record fees, certified-mail costs, postage, publication fees, auction charges, payment-processing fees, and other third-party expenses are nonrefundable after they are incurred.

When a client cancels before all prepaid work has been completed, Auto Lien Service will refund any identifiable, unused prepaid service fees after deducting:

  • Fees for work already completed

  • Nonrefundable third-party costs

  • Authorized expenses

  • Any unpaid amount due on the file

No refund is due merely because an owner redeems or retrieves a vehicle, a debtor pays the claim, a vehicle is released, an auction receives no bids, a party disputes the lien, or Oregon DMV requests additional documents.

Deadlines and Client Delays

Auto Lien Service tracks deadlines based on the facts and documents provided. The client remains responsible for submitting the file early enough to permit review and processing.

Auto Lien Service is not responsible for a missed or shortened deadline caused by:

  • Late intake

  • Inaccurate or incomplete information

  • Delayed client responses

  • Delayed payment

  • Postal or publication delays outside Auto Lien Service's reasonable control

  • Government processing delays

  • Weather, outages, emergencies, or other events outside reasonable control

Auto Lien Service may decline an urgent file when sufficient processing time is unavailable.

Notices and Delivery

Auto Lien Service may send communications and documents by email, telephone, postal mail, certified mail, website form, or another agreed method.

The client must maintain current contact information and monitor communications. Email delivery, postal delivery, publication, or government processing cannot be guaranteed.

Auctions and Proceeds

When auction support is included, the client must follow the applicable Oregon procedure and provide access, vehicle information, sale information, and other required cooperation.

Auto Lien Service does not guarantee:

  • Auction attendance

  • A minimum bid

  • A completed sale

  • Recovery of all charges

  • The condition or marketability of the vehicle

  • The buyer's ability to obtain title

The client remains responsible for handling auction proceeds, surplus funds, vehicle release, possession, and accounting unless a written service scope assigns a specific task to Auto Lien Service.

Title Support

Auto Lien Service may prepare the applicable foreclosure certificate and related sale documents based on the accepted service scope.

The buyer or other lawful applicant generally remains responsible for submitting the title application, paying Oregon DMV fees, completing a required VIN inspection, and providing additional documents requested by Oregon DMV.

Auto Lien Service does not issue titles and cannot compel Oregon DMV to approve an application.

No Legal Services or Guaranteed Outcome

Auto Lien Service is not a law firm and does not provide legal advice.

Auto Lien Service does not guarantee lien validity, priority, enforceability, debt recovery, auction results, title issuance, or the outcome of a dispute. The client should consult an Oregon attorney when legal rights, litigation, bankruptcy, priority, ownership, possession, or statutory interpretation is disputed or uncertain.

Records

Auto Lien Service may retain copies of file records for business, legal, insurance, accounting, and compliance purposes.

The client must maintain its own records. Oregon lien claimants may have independent record-retention duties, including duties to preserve lien-acquisition and foreclosure records for at least five years.

Confidentiality and Privacy

Auto Lien Service handles personal information according to its Privacy Policy and applicable law. The client must transmit and use vehicle-owner information only for lawful file-related purposes.

The client may not publish, resell, or use DMV-derived information for unrelated marketing, harassment, surveillance, or personal purposes.

Limitation of Liability

To the extent permitted by law, Auto Lien Service's aggregate liability arising from a specific paid file will not exceed the service fees paid directly to Auto Lien Service for that file.

Auto Lien Service is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost business; vehicle depreciation; storage losses; or third-party decisions.

This limitation does not exclude liability that cannot lawfully be limited.

Client Indemnification

To the extent permitted by law, the client agrees to defend and indemnify Auto Lien Service against third-party claims, damages, penalties, and expenses arising from:

  • False, incomplete, or misleading client information

  • Unlawful possession, towing, storage, charges, sale, or record use

  • The client's failure to follow applicable law

  • A dispute concerning the underlying debt or vehicle

  • Client actions outside Auto Lien Service's accepted scope

Governing Law and Disputes

Oregon law governs these Service Terms, without regard to conflict-of-law principles.

The parties should first attempt to resolve a dispute through direct written communication. Any unresolved dispute will be brought in a court with lawful jurisdiction in Oregon unless the parties agree to another lawful process in writing.

Changes to These Terms

Auto Lien Service may update these Service Terms for future files. The terms accepted when a file is opened govern that file unless the parties agree in writing to an update.
